Welcome to the HEALTHYYOU WITH DR WUMI platform (“Platform”). The following Terms and Conditions govern your access and use of our services. By using the Platform, you agree to these Terms in full. If you disagree, please do not use our Platform.

Your use of the Platform establishes a contractual relationship with HEALTHYYOU WITH DR WUMI, and you are bound by these Terms throughout this relationship.

We reserve the right to modify, update, or change these Terms, or any portion thereof, at any time. The date on which these Terms were last updated will appear at the top of this page. Your continued use of the Platform after any such changes constitutes your acceptance of, and your agreement to be bound by the new Terms. You should periodically review these Terms so that you are aware of any revision to which you are bound.

HEALTHYYOU WITH DR WUMI provides a platform that offers wellness and weight management information, guidance, coaching, and support. The platform may include personalized coaching, nutritional and exercise plans, and lifestyle guidance tailored to individual needs.

By using the Platform, you acknowledge and agree that:

You must be at least 18 years old to use the Platform. Certain services provided through the Platform may have additional eligibility requirements based on geographic location and other factors. Age verification will be a part of the registration process.

Your use of the Platform is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the Platform, you agree to the terms outlined in the Privacy Policy.

Our Privacy Policy outlines our practices concerning data handling. We’re compliant with GDPR and PIPEDA, and details on data storage, processing, and transfer can be found in our Data Protection section.

To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and agree to accept responsibility for all activities that occur under your account.

Any content you submit or share through the Platform, including personal information, images, videos, and text (“User Content”), remains your responsibility. You retain ownership of your User Content, and by submitting it, you grant HEALTHYYOU WITH DR WUMI a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of providing and improving the Platform.

All content, graphics, designs, interfaces, code, and other elements of the Platform are exclusively owned by HEALTHYYOU WITH DR WUMI and are protected under copyright, trademark, patent, trade secret, and other applicable intellectual property laws. This includes, but is not limited to, the overall design and arrangement of the Platform. By accessing or using the Platform, you agree not to copy, download, modify, distribute, display, or create derivative works from any part of the Platform unless expressly permitted by HEALTHYYOU WITH DR WUMI. Furthermore, all HEALTHYYOU WITH DR WUMI logos, product and service names, and slogans are trademarks or registered trademarks of HEALTHYYOU WITH DR WUMI. Unauthorized use of any HEALTHYYOU WITH DR WUMI trademarks in advertising, promotional activities, or commercial endeavours is strictly prohibited without prior written consent. If you believe any content on the Platform infringes on your intellectual property rights, you are encouraged to notify HEALTHYYOU WITH DR WUMI with detailed information regarding the alleged infringement. Any violation of these intellectual property provisions may result in both civil and criminal legal consequences, and HEALTHYYOU WITH DR WUMI reserves the right to take appropriate legal action against violators.

All payments in respect of the Platform Services shall be made to the Platform. To the extent permitted by applicable law and subject to the Platform’s Privacy Policy, you acknowledge and agree that the Platform may use certain third-party vendors and service providers, including payment gateways, to process payments and manage payment card information.

To make payments online, you undertake to use a valid payment card or bank details, or third-party wallets or details required for any other mode of payment (“Payment Details”) with the authority to use the same, to have sufficient funds or credit available to complete the payment on the Platform in good standing. By providing the Payment Details, you represent, warrant, and covenant that: (1) you are legally authorized to provide such Payment Details; (2) you are legally authorized to perform payments using such Payment Details; and (3) such action does not violate the terms and conditions applicable to your use of such Payment Details or applicable law. You agree that you are responsible for any fees charged by your mobile carrier in connection with your use of the payment services through your mobile. The Platform shall use the Payment Details as described in the Platform’s Privacy Policy. You may add, delete, and edit the Payment Details you have provided from time to time through the Platform.

The payment receipt for completion of a transaction shall be provided by the respective Vendors and the transaction summary shall be provided by the Company, the payment receipt and transaction summary shall be made available on the Platform and sent to your registered email address. Company collects the payment on behalf of the respective Vendor, and eventually settles the same.

Except to the extent otherwise required by applicable law, the Platform is not liable for any payments authorized through the Platform using Your Payment Details. Particularly, the Platform is not liable for any payments that do not complete because: (1) your payment card or bank account or third party wallet does not contain sufficient funds to complete the transaction or the transaction exceeds the credit limit in respect of the Payment Details provided; (2) you have not provided the Platform with correct Payment Details; (3) your payment card has expired; or (4) circumstances beyond the Platform’s control (such as, but not limited to, power outages, interruptions of cellular service, or any other interferences from an outside force) prevent the execution of the transaction.

All fees are non-refundable, and users cannot reverse payments or purchases unless specifically permitted by law, as indicated on the website or in the services. Nevertheless, we reserve the right, at any time, and at our sole discretion, to reject or cancel any transaction or attempt.

The Platform and / or relevant service provider(s) / vendor shall have the right to cease/terminate relationship with you unilaterally without any reason, and applicable amount or cash back (if any) or pro-rata refund, as the case may be, shall be refunded to you subsequently.

With regards to payments, the Platform shall not be responsible for any unauthorized transactions conducted on our Platform using your payment card or internet banking. The Platform shall not be obligated to refund any money to you in such instances.

HEALTHYYOU WITH DR WUMI and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Platform.

You agree to indemnify and hold harmless HEALTHYYOU WITH DR WUMI and its affiliates, including any third-party platforms such as WhatsApp Groups, Facebook Groups etc., which you hereby agree that it could be used for interactions and activities, from any claims, damages, liabilities, costs, or expenses arising from your use of the Platform or participation in any related activities. This includes, but is not limited to, any issues, disputes, or incidents that may arise from interactions within these groups. You expressly acknowledge that HEALTHYYOU WITH DR WUMI shall not be held liable for any such matters and that your participation in these groups is entirely at your own discretion and risk.

HEALTHYYOU WITH DR WUMI reserves the right to terminate your access to the Platform at any time for any reason, without prior notice.

The Platform is provided “as is” without warranties of any kind. HEALTHYYOU WITH DR WUMI disclaims all representations and warranties, express or implied, not expressly set out in these Terms. Any health and wellness content is for informational purposes and isn’t a substitute for professional medical advice.

Links are provided for convenience. HEALTHYYOU WITH DR WUMI isn’t responsible for third-party content or practices.

These Terms are governed by and construed in accordance with the laws of the province of Alberta and the applicable federal laws of Canada, without giving effect to any common law or statutory principles of conflicts of law. You expressly attorn to the jurisdiction of the courts of Alberta and agree that any disputes or matters arising from, connected with, or relating to these Terms or your use of the Platform shall be brought to the relevant court located in Alberta, Canada.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and HEALTHYYOU WITH DR WUMI regarding your use of the Platform, superseding any prior agreements or understandings.
